Bombay High Court Grants Anticipatory Bail in Wife Suicide Case.

In a significant order, the Bombay High Court granted anticipatory bail to a husband accused of abetment of suicide.

The order was passed by Justice N. R. Borkar while hearing an Anticipatory Bail Application filed by the accused apprehending arrest in connection with Crime No. 806 of 2025 registered at Tulinj Police Station by the mother of deceased.

According to the prosecution, the deceased who was the wife of the applicant/accused allegedly consumed poison on 17 November 2025 and later succumbed during treatment on 21 November 2025. It was alleged that the applicant/accused used to suspect her character and demand money for purchasing a flat, and that such harassment led to her taking the extreme step.

During the hearing, the defence led by Adv. Sumit D. Sharma submitted that the FIR was lodged after a delay of ten days from the alleged incident, indicating that the allegations were an afterthought. It was further argued that custodial interrogation of the applicant was not necessary and that he was willing to cooperate with the investigation.

The prosecution relied upon two dying declarations recorded the Court noted that the first dying declaration contained no incriminating allegations against the applicant. While the second dying declaration mentioned a demand for money, the Court observed that prima facie, it appears that there are no allegations of
harassment.

Considering the overall facts and circumstances of the case, the Court granted anticipatory bail to the applicant.
